In Ohio, the probate process first consists of filing an application to administer the estate with your local county probate court. Next, an executor (if there is a will) or administrator (if the decedent did not leave a will) is appointed by the Probate Court. Also, at this time an appraiser is usually appointed, if necessary. Thereafter, all assets are identified and consolidated, and certain debts are noticed and/or paid off by the executor or administrator. There is then a filing of an inventory and a final accounting to close the estate. In the interim assets are distributed to the proper beneficiaries and Ohio Estate Tax Returns and Federal Estate Tax Returns are filed if necessary.
